Please reach out to your proctor through the proctor chat box if you experience any issues during your exam. If you have been disconnected from the chat box, please reach out via the “Support” chat feature located in the Guardian Secure Browser. Proctors cannot advise on how to answer an exam question, scoring, or exam results.

HOW DO I KNOW WHEN I AM BEING MONITORED BY A REMOTE PROCTOR?

A red circle will appear in the top right-hand corner of the Guardian Secure Browser, noting that you are being recorded. You are required to consent to being recorded prior to connection with a remote proctor.

AFTER THE TESTING SESSION, HOW DO I KNOW THAT I AM NO LONGER BEING REMOTELY MONITORED?

The proctor will disconnect from the proctor chat box once you verify that you have submitted your exam and completed the closing steps—this will remove remote access to your computer. This applet is automatically deleted (uninstalled) from your machine once closed by the proctor. After finishing the post-exam satisfaction survey, close the Guardian Browser on your desktop and on your second camera device to fully disconnect from your proctoring session. If desired, you may uninstall the Guardian Browser after exam completion.

About the Interprovincial Challenge Exam

WHAT IS THE INTERPROVINCIAL CHALLENGE EXAM?

The Interprovincial Challenge Exam assesses a learner's knowledge of the laws that apply to trading in real estate in Ontario. Upon successful completion of the Interprovincial Challenge Exam, qualified individuals may apply to RECO for registration as a salesperson or broker.

Please note: The Ontario Labour Mobility Act allows those who hold a valid real estate salesperson or broker licence in a qualifying Canadian province or territory the ability to write the Interprovincial Challenge Exam.

WHO IS ELIGIBLE TO TAKE THE INTERPROVINCIAL CHALLENGE EXAM?

The Interprovincial Challenge Exam is available to licensed individuals who are registered or certified in real estate in an approved province or territory outside of Ontario.

Please visit RECO’s website to confirm if you are eligible to take the exam before you register https://www.reco.on.ca/agents-and-brokerages/moving-to-ontario.

WHAT KNOWLEDGE AREAS ARE COVERED IN THE INTERPROVINCIAL CHALLENGE EXAM?

The Interprovincial Challenge Exam focuses on the skills and competencies that may be Ontario specific, such as: Ontario laws, including real property law, commercial and residential real estate transactions in Ontario, and RECO’s governing legislation, the Trust in Real Estate Services Act, 2002 (TRESA).

Specifically, knowledge areas covered in the exam are:

Understanding Trust in Real Estate Services Act, 2002 (TRESA)

  • Demonstrate understanding of the salesperson's obligations under TRESA to protect consumers by maintaining legislative standards of professional conduct when interacting with consumers and seller or buyer clients during residential and commercial real estate transactions.
  • Demonstrate understanding of the salesperson's obligations under TRESA to promote and protect consumers by ensuring you complete tasks and activities with due diligence during residential and commercial real estate transactions.

TRESA and Representation

  • Identify the services that may be provided to a seller client or a buyer client.
  • Describe the salesperson's obligations when representing buyers.
  • Identify the requirements when working with multiple offers on a residential property.
  • Examine additional registrant obligations and disclosures.
  • Demonstrate an understanding of a salesperson's duties and obligations required under TRESA for multiple offers, written direction for receiving offers and pre-emptive offers from both seller and buyer perspectives in residential and commercial real estate transactions.

Key Legislation and Regulations: Residential and Commercial – Fraud, Privacy and Anti-Spam Legislation

  • Demonstrate understanding of a salesperson’s obligations related to FINTRAC in residential and commercial transactions (e.g., brokerage compliance officer and program, policies and procedures, record-keeping and current education program).
  • Demonstrate understanding of a salesperson’s obligations to identify suspicious activity per FINTRAC requirements in residential and commercial transactions.
  • Demonstrate understanding of anti-spam (CASL) legislation, the National Do Not Call List (NDCL) and a salesperson’s related obligations in residential and commercial real estate transactions.
  • Demonstrate understanding of the legislative requirements related to electronic signatures described in the Electronic Commerce Act and how it relates to a salesperson's obligations in residential and commercial real estate transactions.

TRESA and Key Legislation: Residential and Commercial – Property Legislation, Conditions, Rights, and Limitations

  • Demonstrate understanding of the Municipal Act and the Planning Act and how you impact a salesperson's activities in residential and commercial transactions.
  • Explain the requirements regarding the seller's obligations for disclosure
  • Demonstrate understanding of legislation related to TRESA, Ontario Building Code, Municipal bylaws and zoning bylaws, Family Law Act, Income Tax Act and the Commercial Tenancies Act.

TRESA and Key Legislation and Regulations – Residential and Commercial Condominiums

  • Demonstrate understanding of how the Condominium Act and its associated legislation impact a salesperson's activities during residential and commercial real estate transactions.
  • Describe the governance and legal requirements related to condominium properties a salesperson should be aware of when involved in residential and commercial transactions.
  • Describe additional legislative and regulatory requirements specific to new condominiums that can impact a salesperson's activities in residential and commercial transactions.

TRESA and Key Legislation and Regulations: Residential & Commercial Leasing

  • Demonstrate understanding of how the Residential Tenancies Act and Commercial Tenancies Act and how it impacts a salesperson's activities in residential and commercial transactions.
  • Describe additional legislative and regulatory requirements specific to leasing properties that can impact a salesperson's activities in residential and commercial transactions (e.g., Ontario Human Rights Code).

TRESA and Other Relevant Legislation

  • Demonstrate understanding TRESA requirements for business brokerage transactions.
WHAT HAPPENS IF I FAIL THE INTERPROVINCIAL CHALLENGE EXAM?

If a learner fails the exam, they must rebook and repay the full fees to schedule another attempt. There is no maximum attempt limit for the Interprovincial Challenge Exam.

WHAT HAPPENS AFTER PASSING THE INTERPROVINCIAL CHALLENGE EXAM?

After passing the exam, learners will have 12 months to apply for registration with RECO.

Please note that although learners are given 12 months to register with RECO after passing the exam, to be eligible to register they must still meet requirements for registration under the Ontario Labour Mobility Act when submitting their application. This means that when a learner applies to RECO for registration, they must be currently registered/licensed in their originating jurisdiction. A learner will only qualify to apply if they meet all the eligibility requirements. For more information on eligibility, please visit RECO’s website.

Will ICE test-takers be allowed to register as a salesperson or broker with RECO?

Successful completion of the Interprovincial Challenge Exam allows qualified applicants to acquire registration with RECO in the equivalent category as the one currently registered to them in their originating jurisdiction(s). When applying for registration, RECO will (at that time) determine the applicant’s eligibility for salesperson or broker registration under TRESA 2002. The determining factor will be the category of registration/licence held by the applicant in their originating jurisdiction at the time of application, and whether the registration/licence category is “equivalent” to a salesperson or broker registration category, as defined under TRESA 2002.

What happens if a learner fails to apply for registration with RECO within 12 months of passing the exam?

Should a learner fail to apply for registration with RECO within 12 months of completing the Interprovincial Challenge Exam, they must retake the exam to again be eligible to apply to RECO for registration as a salesperson or broker. Extensions are not permitted.

What if a learner was previously registered/licensed or completed a recognized program in another province—can they still write the Interprovincial Challenge Exam?

Learners will only qualify to take the Interprovincial Challenge Exam if they are currently licensed, registered, or otherwise authorized to trade in real estate in one-or-more of the qualifying Canadian provinces or territories.

If a learner does not qualify to write the Interprovincial Challenge Exam, they may still be eligible to apply to RECO for education equivalency assessment. Please visit RECO’s Education Equivalency Assessment page for more information.
